What happens if a friend of mine goes to jail in Ventura and asks me to help him pay for his bail bond?
If you have a friend that is in jail in Ventura county and your friend has asked you to help pay for his bail bond, then it is up to you to decide whether or not you want to help him. You need to be aware that if you do help your friend pay for the cost of his bail bond, you may not ever get that money back. Here’s some more information about how bail works so that you can make an informed decisions:
Bail is the money that a court uses as assurance that a defendant will show up to court in order to stand trial for a crime that he or she is accused of committing. After a person is arrested for the crime, the person will be taken to jail and booked. A pretrial representative and a judge will both take a look at the situation and the crime. Sometimes, the situation is such that a bail will not be granted. Other times, a judge will let a defendant leave jail on his or her own recognizance.
When a jail decides that the person can only leave jail if he or she pays bail, the judge is basically saying that the person has a chance of not showing up to court in order to stand trial for the crime, so that bond is money that the defendant will have to put up. That money will be returned to the defendant (or the people that pay the money for the defendant) if the defendant shows up to court. However, if the defendant fails to show up, then the defendant will not get the money back. As such, you can see how the money is a form of a surety.
If your friend has asked you to bail for the bail, your friend is asking you to pay for one of two things: 1. The bail amount; or 2. The down payment for the bail.
If your friend is asking you to help pay the bail amount, then this money may be returned to you. Generally, if a defendant can afford to pay the bail amount, it means that he or she either has enough cash set aside to pay the bail, or it means that he or she has enough friends and family members that can loan him enough money. Bails can range in price from about $6,000 to $1 million.
If your friend is asking for your help to pay the down payment, then you will not get this money back unless the friend specifically returns the money to you. The down payment is the amount of money that is given to a bail bonding agency in order to have the bail bonding agency put up the full amount of bail that is required to get a defendant out of jail. As long as the defendant shows up to court, the bail bonding agency will get this money back. However, if the defendant fails to show up to court, then the bail bonding agency will not get this money back. In either event, the down payment will not b refunded to the defendant.
As such, it is important to understand how your friend intends to repay you for the bail money that you give him, if you end up giving him bail money. Otherwise, you may not see your money again.
